1. Acceptance of Terms
TheGreenKey (the "App" or "Platform") is a proprietary software product owned and operated by Jeckl Development Concepts LLC, a limited liability company based in Texas, United States. By accessing, registering for, or using the App, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the platform.
2. Nature of Service
TheGreenKey provides an administrative behavioral screening platform for landlords, property managers, and mortgage lenders ("Clients") to assess prospective tenants or homebuyers ("Applicants"). The App utilizes an AI-driven "Behavioral Reliability Index" (BRI) to generate integrity-based predictive reports. TheGreenKey provides its platform solely as an administrative tool to facilitate the tenant screening and placement process.
3. Compliance with Laws (FCRA & Fair Housing)
- For Clients: You agree to strictly comply with the Fair Credit Reporting Act (FCRA), the Federal Fair Housing Act, and all applicable state and local laws regarding applicant screening and non-discrimination. You bear sole and absolute responsibility for all leasing and lending decisions, including the approval or denial of any applicant. You represent and warrant that you have a "permissible purpose" under applicable law to request an assessment for any Applicant.
- For Applicants: You acknowledge and agree that the background information, personal data, and responses you provide will be transmitted directly to the Client and used by them to make independent housing or lending decisions.
4. Subscription Tiers, Fees, and Payments
- Client Subscription Tiers: Access to platform features is governed by your selected subscription tier (Trial, Bronze, Silver, Gold, Platinum).
- Platform Component Fees: Payment for additional applicant invites ($5.00), applicant assessment report data retrieval ($10.00), and assessment report downloads ($1.50) are strictly non-refundable once the data is accessed or the invite is issued.
- Application Processing Fees: The standard processing fee for a submitted leasing application is established at $50.00 USD per applicant.
- Stripe Connect Processing & Split Fees: All transactions are securely processed through a third-party payment processor, Stripe. Application fees are paid directly to the landlord or leasing manager via Stripe Connect. The deduction of base processing fees, platform split cuts (such as the tier-based platform fee of $7.50 per $50 application for Trial, Bronze, and Silver tiers, or $0 for Gold and Platinum tiers), and the assessment of applicable sales taxes are determined and deducted dynamically at checkout based on individual account configurations and regional state regulations. Users and Clients are entirely responsible for any state-specific taxes calculated at checkout.
5. Automated Workflows and Candidate Selection Eligibility
In the event an applicant declines to proceed via the automated workflow, or fails to meet the 60% automated threshold, the Client retains the exclusive prerogative to manually bypass the system and dispatch a leasing application directly via the Client portal.
Achieving this score strictly establishes the applicant's eligibility to receive an invitation to proceed to the formal application phase. The decision to complete the formal lease application and submit the non-refundable $50.00 processing fee rests entirely at the voluntary option and discretion of the applicant.
6. Data Privacy, Confidentiality, and Permitted Use
By accessing a prospective tenant's personally identifiable information (PII) or behavioral reporting data transmitted through the platform, the Client agrees to utilize such data strictly and exclusively for the purpose of evaluating and making independent leasing or lending decisions. The Client covenants to maintain the absolute privacy and confidentiality of this information at all times, and shall not disclose, sell, or distribute such data to any third party unless explicitly required to do so by a court order or applicable law.
7. Limitation of Liability and Disclaimer of Warranties
TheGreenKey employs proprietary artificial intelligence and algorithmic modeling to provide an objective assessment of an applicant's behavioral reliability. While designed for high-level predictive accuracy, this system is provided on an "as-is" and "as-available" basis.
- Jeckl Development Concepts LLC makes no express or implied warranties, including but not limited to warranties of merchantability or fitness for a particular purpose.
- TheGreenKey explicitly disclaims any and all warranties regarding the success, failure, or outcome of your tenant placement efforts. TheGreenKey does not guarantee that any applicant will fulfill their contractual obligations.
- Jeckl Development Concepts LLC shall not be held liable for any vacancies, financial losses, lease defaults, mortgage delinquencies, property disputes, or tenancy losses resulting from housing or lending decisions made in reliance upon these reports or the use of this platform.
8. Third-Party Payment and Operational Support Disputes
- Payment Disputes: TheGreenKey exercises no control over, and assumes no liability or responsibility for, the completion, banking declines, non-receipt, or failure of any prospective tenant's payment transactions. All billing inquiries, transaction chargebacks, and payment support requests must be directed exclusively to Stripe or handled directly between the applicant and the landlord/leasing manager.
- Leasing Support: Any and all questions, concerns, updates, or disputes regarding the status of a rental application, property viewings, or the overall leasing process must be directed exclusively to the landlord or leasing manager. TheGreenKey does not provide tenant support for individual leasing workflows.
9. Applicant Addendum: Disclosures & Acknowledgments
(This section applies explicitly to Applicant users passing through the portal.)
- Direct Transmission of Data: By completing and submitting this rental application form, you explicitly acknowledge and agree that all provided personal data, background information, and application details will be transmitted directly to the landlord or designated leasing manager of the property.
- No Platform Participation in Leasing Decisions: You understand and agree that TheGreenKey and its affiliates do not participate in, influence, or review any leasing decisions. The sole authority and absolute prerogative to approve or decline a rental application rests exclusively with the respective landlord or leasing manager.
- Disclaimer of Approval Warranties: You acknowledge that submission of this application form does not guarantee, imply, or provide any express or implied warranty that you will be approved for housing or a lease agreement.
- Separation of Support: You acknowledge that operational questions regarding property metrics must be addressed directly to the property managers. TheGreenKey does not manage property management logistics or provide personal leasing tenant support.
